Terms of service

These terms of service ("terms") govern your access to and use of Hong AI (the "service"), an online AI image generation and editing platform. By using the service you agree to these terms. If you do not agree, please do not use the service.

The service lets you generate images from text descriptions and, where available, from reference images, using third-party AI models. Output is generated automatically by machine-learning systems and may be inaccurate, unexpected, or similar to output generated for other users from similar prompts.

We may change, suspend, or discontinue any part of the service at any time, including free features, queue speeds, resolution limits and model availability.

You can use basic features without an account. Some features require an account. You are responsible for your login credentials and for all activity under your account. You must provide accurate information and be at least 13 years old (or the minimum age required in your country) to use the service, and at least 18 to purchase a subscription.

Free plan images include a visible watermark, are limited in resolution and speed, and are licensed for personal, non-commercial use only.

Paid subscriptions (billed monthly or yearly) unlock features such as watermark-free downloads, higher resolution and a faster queue. Our order process is conducted by our online reseller and merchant of record, Paddle.com, who handles payment, invoicing, applicable taxes and customer payment support. Subscriptions renew automatically at the end of each billing period until cancelled.

You can cancel at any time; cancellation takes effect at the end of the current billing period and you keep access until then. Refunds are handled according to our refund policy.

You agree not to use the service to create, upload or share:

• sexual or exploitative content involving minors, or any content that sexualises minors — this is strictly prohibited and will be reported where required by law;
• non-consensual sexual content or pornography;
• content intended to deceive, defame, harass or impersonate real people, including misleading "deepfakes" of public figures;
• content that promotes violence, terrorism or self-harm;
• content that infringes the intellectual-property, privacy or other rights of any third party;
• content that is otherwise illegal in your jurisdiction.

You must not attempt to bypass safety filters, rate limits, watermarks or other technical restrictions, resell the service, or access it with automated scripts. We may remove content, throttle, suspend or terminate accounts that violate these rules.

You keep the rights you hold in prompts and reference images you upload, and you grant us the licence needed to process them to operate the service. You must have the necessary rights to any image you upload.

Subject to these terms and applicable law, we assign to you the rights we hold in images generated for you. Free-plan images may be used for personal, non-commercial purposes only and must retain the watermark; paid plans include a commercial-use licence for images generated while your subscription is active. You are responsible for how you use generated images, including compliance with advertising, IP and publicity laws.

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, availability, or that output will be accurate, unique or suitable for your needs.

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, data or goodwill. Our total liability for all claims relating to the service in any 12-month period is limited to the amount you paid us for the service in that period (or USD 20 if you paid nothing). Nothing in these terms excludes liability that cannot be excluded by law.

You may stop using the service or delete your account at any time. We may suspend or terminate access for breach of these terms, misuse of the service, or where required by law.

We may update these terms from time to time. Material changes will be indicated by updating the date at the top of this page; continued use of the service after changes take effect constitutes acceptance.
